Homes in San Marcos and what to check before an offer

The City's General Plan background report describes San Marcos as primarily residential. Its land use categories range from single-family homes in subdivisions to duplexes, townhomes, condominiums and apartments, and mobile home parks are allowed in some categories. The report also says the city has a large number of specific plan areas (more than 80). Named plans include San Elijo Hills, Santa Fe Hills (Paloma) and the San Marcos Creek Specific Plan.

Mobile homes

The City says 18 mobile home parks operate in San Marcos. It has a rent review ordinance for them. Under the City's page, the review process starts only if a petition is submitted by 51 percent of affected residents.

HOA documents

If you're buying a resale home in a homeowners association (HOA), California Civil Code 4525 lists what the owner must give you before closing, including the governing documents, the latest budget report, current assessments and fees, and any unpaid assessments or fines. No HOA count is published, so ask about each address and read the documents before your contingencies end.

Mello-Roos and other special taxes

A Community Facilities District (CFD), often called Mello-Roos, charges owners inside it a special tax each year, often to repay bonds or pay for services. The City publishes a CFD page. Its list includes CFD 88-1 (Paloma/Santa Fe Hills), CFD 98-02 (Lighting and Landscaping), CFD 99-01 (San Elijo Hills) and CFD 2002-01 (University Commons), as well as districts for police and fire. The County Auditor's FY 2025-2026 list also shows several San Marcos districts. San Marcos Unified School District levies school CFDs and posts CFD disclosure documents.

Whether a home pays a special tax depends on its parcel. Check the current tax bill through the San Diego County Treasurer-Tax Collector and the seller's disclosures.

Wildfire

CAL FIRE's 2025 map for San Marcos's local responsibility area puts roughly half of the city's land in the Very High Fire Hazard Severity Zone, with smaller areas in High and Moderate. Use CAL FIRE's viewer to see where one address falls. The seller's Natural Hazard Disclosure report states whether a home sits in a mapped fire zone. For homes in High and Very High zones, state law has also required documentation on defensible space since July 1, 2021 (Civil Code 1102.19).

Flood zones

Some parts of the city, mainly along San Marcos Creek and its tributaries, are mapped in FEMA flood zones. Look up the address at the FEMA Flood Map Service Center. A home inside a FEMA Special Flood Hazard Area needs flood insurance if the mortgage comes from a federally regulated, supervised or insured lender.

Airport influence area

McClellan-Palomar Airport is in Carlsbad, about 2.5 miles west of San Marcos. The General Plan background report says most of the planning area lies in the airport's influence area, where limits on building heights are the main land use restriction. A Notice of Airport in Vicinity may apply to a resale. Check the address on the Airport Authority's ALUCP mapping tool.

Coastal zone

The County's coastal zone map shows no coastal zone land inside San Marcos city limits. Confirm any address on the Coastal Commission map.

Schools: San Marcos Unified, assigned by address

San Marcos Unified School District serves nearly all of the city. A few edges of the city fall in other school districts, and district lines don't follow city limits, so the exact address decides.

DistrictAddress lookup
San Marcos Unified School DistrictMySchool Locator (enter a street address)

If the locator doesn't return a San Marcos Unified school, the address may be in another district. Ask that district for its own boundary lookup. Only the district can confirm an attendance boundary. This page doesn't rate or rank schools.

Local rules for owners

Accessory dwelling units (ADUs)

The City runs a Permit-Ready ADU program with pre-approved, detached one-story plans. The City says it is meant to save time and money by avoiding initial design and review costs. The plans can't be altered; a customized ADU needs a standard ADU building permit. The City says it will approve or deny an application within 30 days of receiving a complete one. State law (Civil Code 4751) voids HOA rules that effectively prohibit or unreasonably restrict ADUs on single-family lots. This page doesn't cover size limits, fees or parking, so ask the City's Planning and Building divisions before you plan one.

Short-term rentals

The City's Transient Occupancy Tax page says short-term rentals are not permitted in residential zones. The San Marcos TOT rate is 10%, and the tax is required when a property is used for short-term lodging. The City also says a bed and breakfast may apply for a Conditional Use Permit in certain zones. Confirm with the Planning Division before you buy for short-term rental use.

Long-term rentals

The City's housing pages list state housing-production laws and a mobile home rent review ordinance. Those pages don't mention a local rent cap or just-cause rule for apartments, and this page doesn't review the municipal code. California's statewide tenant rules apply, so ask the City or a real estate attorney about a specific rental.

Getting around

Regional access is by State Route 78, an east-west highway that links Interstate 5 with Interstate 15. NCTD's SPRINTER hybrid rail line also runs through the city. It spans 22 miles, connects Oceanside, Vista, San Marcos and Escondido, and has 15 stations along the Highway 78 corridor. Palomar College is a SPRINTER stop in San Marcos, and BREEZE buses serve the San Marcos Civic Center and Cal State San Marcos. In Oceanside, the SPRINTER connects to the COASTER. See NCTD for current schedules.

Parks and landmarks

The City says it has 44 parks on over 300 acres, two pools, three recreation centers and a 72-mile trail network for hiking, biking, running and equestrian use. Its nickname is "San Parkos." Named City facilities include Bradley Park and the 3.4-acre Bradley Bike Park, Buelow Park, Civic Center Park, and Cerro de las Posas Park and Pool, which has a 25-yard heated recreational pool. Jack's Pond Nature Center is at 986 La Moree Road. The City also posts an interactive trail map on its hikes and ranger program page.

Selling a home in San Marcos

If you own in San Marcos, several of the checks above are part of your disclosure package: the Natural Hazard Disclosure report, any airport notice, HOA documents, any Mello-Roos notice and, in High and Very High fire zones, the defensible-space documentation. They go along with the other forms California requires, starting with the Transfer Disclosure Statement, so this isn't a complete list. See selling a house in San Diego for the disclosure list, costs and timing, or request a free home value estimate.
